It is your responsibility to ensure that scripts/programs installed under your account are secure and permissions of directories are set properly, regardless of installation method. When at all possible, set permissions on most directories to 755 or as restrictive as possible. Users are ultimately responsible for all actions taken under their account. This includes the compromise of credentials such as username and password. It is required that you use a secure password. If a weak password is used, your account may be suspended until you agree to use a more secure password. Audits may be done to prevent weak passwords from being used. If an audit is performed, and your password is found to be weak, we will notify you and allow time for you to change/update your password.

Payment-All Accounts

Payment is Due on or before Due Date. A fee of $10.00 will be Imposed to any account that does not pay their Invoice on TIME. AND or your Account will be SUSPENDED

Account Setup & Email on file

We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) incase of fraud. It is YOUR responsibility to provide us with an email address which is not @ the domain(s) you are signing up under. If there is ever an abuse issue or we need to contact you. The primary email address on file will be used to do so. It is YOUR responsibility to ensure the email address on file is current or up to date at all times.
Failure to respond to email from our abuse department within 48 hours may result in the suspension or termination of your services. All abuse issues must be dealt with via trouble ticket and will have a response within 48 hours.

Cancellation and Refunds

We reserve the right to cancel an account at any time. We do not offer refunds for breech of our terms of service.

Customers may cancel at any time. We give you an unconditional 7 day money back guarantee on managed shared hosting, and reseller solution's. Refund requests after 7 days will be refunded on a prorated basis of any unused time, if you selected a 3 month, 6 month, 1 year, or 2 year term*. Partial months are non-refundable..

Only first-time accounts are eligible for a refund. For example, if you've had an account with us before, cancelled and signed up again, you will not be eligible for a refund or if you have opened a second account with us.

Unlimited / Unmetered Hosting Packages

When we say unlimited domains, unmetered disk space or bandwidth, of course there are terms & conditions that you must adhere to. This means unlimited webpages, domains and web graphics, not downloads or streaming media. Our servers are shared hosting servers and memory and CPU usage is not unlimited. CPU intensive files are not permitted on our servers and accounts may not to be used to host a collection of mp3s, audios, videos, anime, .rar files, Warez, gamers sites, shout cast and similar, or to backup your computer or another source. They may not be used for general storage of any type. They may not be used as download mirrors or download/upload portals. While the sale of eBooks and other legal small download files are permitted within reason (see download files below) with the unlimited package, hosting and storage of mass quantities where our servers are used as a distribution point is not permitted.

They may not be used for HYIP (High Yield Investment Programs), Ponzi schemes or pyramid schemes. They may not be used to provide proxy servers. All content stored on a reseller account must be directly used on the Internet by the website associated with that account. These accounts may not be used as a download distribution point for your software or media. They are to be used for standard web practices only. This means that all content stored on an unlimited account must be used for "acceptable" website use. “Unacceptable” usage is anything that a shared server would not be able to provide under standard circumstances and uses a high percentage of CPU or Memory (10%+) usage. Free hosting is not permitted with any of our packages. We will not host resellers that offer the so-called "lifetime" web hosting.

To maintain the quality of our bandwidth and servers, we do not tolerate violations and attempted violations of system and network. We do not allow mini download sites, warez sites, or proxy sites.

Acceptable Use Policy

The Internet is a powerful information and entertainment tool, we would expect our customers to use the Internet with respect, courtesy, and responsibility, giving due regard to the rights of other Internet users.

Our acceptable use policy is actively and strictly enforced. Offending content or users are removed from our network, usually as soon as they are discovered, although we will always inform you when and why any action has been taken, if possible.

Common sense is the best guide as to what is considered acceptable use, however the following are unacceptable uses.

Illegality: In any form, including but not limited to the unauthorized distribution or copying of copyrighted software or other data, harassment, fraud, or trafficking in obscene material.

Undesirable Content: Certain types of content are not permitted on our network. We do not host pornographic content of any description, unless your plan comes with this feature, or you selected adult content as an option.. We reserve the right to determine what constitutes pornographic content and what does not (see adult sites below). Content relating to Hacking, Cracking, Warez and IRC is not allowed. Software downloads may only be hosted if you are the writer and copyright owner of the software, all other software including freeware, shareware and trial software is forbidden. The sale of resalable eBooks is ok.

Bulk Email: The use of our network to send bulk email whether opt-in or otherwise, and the use of bulk email to promote a site on our network is strictly forbidden. As a guideline, we consider sending over 200 emails at once as bulk email.

Misuse Of Resources: Including but not limited to employing applications which consume excessive CPU time, memory or storage space. Chat/IRC, web proxy and mailing list scripts are not allowed on our network under any circumstances. Streaming media, audio, video and shout cast can be a drain on web server resources and as such is not allowed. CGI based message forums which use flat file databases are often found to use excessive system resources, to avoid disappointment please use a PHP message forum. The use of web cam applications which maintain a constant FTP connection uploading an image at regular intervals is forbidden.

Password Protected Directories: Using password protected directories to conduct illegal activities is strictly prohibited. Sites that use password protected directories where their use is not clear are subject to suspension while we investigate the legality of the hidden content.

If you are unsure about content you intend to place on our network, please check with us before you do. We reserve the right to determine what constitutes acceptable use.

Our Acceptable Use Policy must be followed by all end users and resellers.

Download Files

Collections of download files are not permitted on shared servers because they slow the server down. A reasonable amount of download files can be permitted if you keep the file size under 2000 k.

Adult Sites

Adult commercial sites are permitted including: lingerie sales, adult toy e-commerce sites, Viagra sales, adult health and sexuality, and similar if all models are over 18. Pornographic media is only permitted if your site is adult content enabled. Pornographic media sites MUST have a disclaimer page, and only sites with LEGAL content are allowed. No underage models or children.

FFMPEG and Video Streaming

We will allow Video Streaming sites and even sites that requires FFMPEG to run, but you are responsible for the content of the site. No illegal use of copyrighted materials are allowed.
Video Streaming or FFMPEG is only allowed if your site is FFMPEG enabled

Hosting Account Cancellation

You may cancel your account within 7 days of opening the account for a full refund, excluding add-ons, overages, domain names, etc. for a full refund, if your account was not suspended due to breaking any of our policies. After 7 days, you may cancel at anytime with a 5 day notice. If you prepaid 1 year to save money, but for some reason need to cancel your service early, then your contract will revert to a month-to-month contract and we will refund the difference between the 1 year prepay rate and the rate had you signed up for month to month service from the beginning. Any partial month will not be refundable. Canceling your PayPal or 2CheckOut subscription may result in immediate cancellation of your hosting account regardless of any remaining time left that you have pre-paid for. Be sure that you have copies of your web files before you cancel your hosting. Please see our Acceptable Use Policy / TOS for further information.

Data Back-Up

Although regular remote back-ups will be performed (some servers have local backups), We will not be held responsible for any loss of data. It is up to the hosting account to ensure you maintain a local copy of your web data for your own back-up purposes.

Forum Posts & Reviews

We have a zero tolerance policy for posting negative feedback on any public forum or review site about our company and/or our employees before submitting a ticket to our 'Feedback' department to discuss your issue will result in immediate account termination without any refund. Although it is your right to post feedback without discussing your issue with us first, it is undoubtedly unfair and unprofessional not to, which is not the type of client we want to deal with. We have the utmost respect for all of our clients, and are more than fair with all of our clients. We will do anything and everything possible to keep all of our clients satisfied. But in the unlikely event you are not satisfied, all that we ask is to discuss your issue with our Feedback department first. So if you are the type of person to run to the forums or review site at the first chance you get to complain, please do not sign up with us.
